Nova Scotia Tourism - Official Terms & Conditions 

By clicking on "I accept", and in consideration of the opportunity to post your materials, you agree to the following binding contractual terms respecting any videos, photographs, stories or other content (collectively, "Materials") you submit to any of Nova Scotia Tourism’s websites, including Nova Scotia Tourism's Nova Scotia Blogs pages (the "Websites"):

1. You must be an adult: You guarantee that you are 19 years of age or older (and are an adult under the laws of your home jurisdiction).

2. You grant us permission to use your Materials: You grant to Nova Scotia Tourism, its affiliates, agents and partners (collectively "Nova Scotia Tourism") a royalty-free license and permission to use, display, reproduce and distribute the Materials provided by you, on Nova Scotia Tourism’s My Favourite Places page, and also in any advertising, information or promotion about Nova Scotia. You waive all moral rights, and agree that Nova Scotia Tourism may modify and edit your Materials, and combine them with other materials. Your permission is granted for all media now or later devised, worldwide, in perpetuity.

3. You own all rights to the Materials: You guarantee to Nova Scotia Tourism that you are the sole owner of all rights, including copyright, in the Materials, that no other party owns any rights of any kind associated with the Materials, and that the Materials you submit are royalty-free and can be freely used for the purposes expressed above. You further guarantee that no Materials you submit, nor any permitted uses by Nova Scotia Tourism, will violate any copyright, trademark, contract, publicity, privacy or any other rights of any person or entity. Copyright and ownership of all Materials remains with you, subject to the rights granted to Nova Scotia Tourism under this Agreement.

4. You have permission from all people who appear in your Materials: You grant permission, and you guarantee that you have permission from all others who appear in the Materials, for Nova Scotia Tourism to use your and their names, photographs, likenesses and recordings for the purposes described above, royalty-free.

5. You release and indemnify us: You are solely responsible for the Materials you post or otherwise make available to Nova Scotia Tourism, and you release and indemnify Nova Scotia Tourism, its affiliates, agents and partners and their respective directors, officers, agents and employees from and against any and all claims, liabilities, damages, demands, losses and expenses (including legal fees), arising out of the posting on the Websites of any Materials or any of the permitted uses of the Materials by Nova Scotia Tourism.

6. Further Terms about Materials: You agree that

a) Nova Scotia Tourism will select, use and post Materials in its sole discretion, does not make any representation that your Materials will be posted or used, and reserves the absolute right to post and remove Materials from time to time as it sees fit.
b) Your right to submit Materials to the Websites may be revoked by Nova Scotia Tourism in its sole discretion at any time.
c) Nova Scotia Tourism is not be responsible in any way for any use or exploitation of your Materials by third parties as a result the Materials having been used by Nova Scotia Tourism; and
d) By submitting Materials and otherwise using any Websites, you agree to comply with and be bound by the Websites’ terms and conditions applicable to all visitors, as may be posted on those Websites from time to time.

7. Nova Scotia Law: You acknowledge that this agreement is governed by the laws of Nova Scotia and any disputes are subject exclusively to the courts of Nova Scotia.
